Tickets may be cancelled and a 100% refund issued, if you cancel at least 4 days (96 hrs) before your sail. 

Once inside the 4 day period, tickets will be refunded only if your sail is cancelled by us due to weather. See below*.

If we cancel your sail due to adverse weather conditions,  you will receive a 100% refund, can choose to reschedule, or receive a gift certificate for a future trip.

The final decision to sail resides with us. If you've purchased a ticket and decide not to show up because of the weather and the boat sails, your tickets or charter is non-refundable.

There is no smoking aboard our vessel.

Pets are not permitted. :( sorry.

You are not permitted to bring your own alcohol aboard our vessel. 

If you arrive late for your departure and miss the boat your ticket cannot be refunded.  

Boarding may be denied if you arrive visibly intoxicated. 

Should passenger actions or behavior make the crew feel that safety is compromised or that they are unable to focus on sailing the boat and maintaining safe conditions, the captain reserves the right to deny service and/or return the offending individual/group to the harbor. No refunds will be issued.


WEATHER*

Our sails run in light to moderately inclement weather. Don't worry, we won't send you out in heavy rain, thick fog, high winds or if threatening weather appears imminent. However, we will sail in cloudy, overcast conditions, on and off sprinkles and in light fog. 

Bring your sense of adventure! We have ponchos available in case of light showers. Keep in mind that unfortunately we can't guarantee you a postcard picture-perfect sunset and we won't cancel a "sunset sail" just because it's overcast.

If the weather looks questionable, we'll check the radar before we leave and if it looks like it's going to start pouring rain for most of the sail, we will cancel. If it looks like there might be an occasional light sprinkle, we'll go! 

Some days it may rain all morning only to clear up in the afternoon, or pour all day only to stop just before our sunset sail. We have also seen days where the chance of rain is 80% and it never rains. The timing and paths of thunderstorms are very hard to predict, therefore a decision to cancel a sail because of a thunderstorm watch is typically only made 30 minutes before departure.

We have had many enjoyable trips in less than spectacular conditions. We think this policy is fair and appreciate your cooperation.

By redeeming your boarding pass you agree to the following terms: 

  • You acknowledge that sailing is inherently dangerous and waive all risks outside the reasonable control of the owners or operators of SAIL EAST operated vessel.

  • You agree that SAIL EAST shall not be held vicariously liable for the intentional or negligent acts of any person not employed by SAIL EAST or committed while off duty or outside the course and scope of employment.

  • SAIL EAST shall have the benefit of all statues of the United States of America providing for limitation and exoneration from liability.

  • SAIL EAST shall not be liable to you for damages for emotional distress, mental suffering/anguish or psychological injury. 

  • SAIL EAST shall not be liable for any other claims unless filed within six months of voyage.

  • All disputes and matters whatsoever arising under, in connection with or incident to this contract shall be litigated before the United States District Court for the Southern District of New York in Manhattan or before a court located in New York County, New York.
